Terms and Conditions of Use and Contracting of QUOTATIONIA

Last updated: October 2026

Important notice — please read these terms and conditions carefully before using our website.

Access, browsing, registration, and/or use of any service offered through the website http://www.quotationia.com (hereinafter, the "Website") grants the individual the status of "User" and constitutes full and unconditional acceptance of all provisions contained in these Terms and Conditions (hereinafter, the "Terms"). If you do not agree with any of the conditions set forth herein, you must refrain from using the Website and from contracting the services provided by QuotationIA (hereinafter, "QuotationIA," the "Company," or the "Provider").

1. Use of the Website

QuotationIA provides Users with a technological platform that enables, through the use of algorithms and artificial intelligence systems, the automatic generation of estimates and quotation documents in digital format. By entering information related to the work, services, or materials to be quoted, the AI processes the data and generates a detailed and presentable economic proposal, which the User may view and, where applicable, download.

The Service is offered for use by individuals, professionals, and businesses. Under no circumstances does QuotationIA act as executor of the work, main contractor, intermediary, or guarantor of the ultimate accuracy or suitability of the information included in the generated estimates; the documents are for guidance purposes only. It is the User's responsibility, if deemed appropriate, to verify them with professionals or specialized providers before using them in contractual relations with third parties.

2. Disclosure on Privacy, Security, and AI Providers

The User expressly acknowledges and accepts that QuotationIA uses third-party services for the provision of the Service, including, primarily but not exclusively, artificial intelligence technologies provided by Google and cloud service providers for data processing and storage. Such use may involve transfers of data outside the European Economic Area; in all cases, QuotationIA implements contractual and technical measures intended to ensure an adequate level of protection in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national regulations.

Furthermore, the User accepts that the proper functioning of the Website requires the use of cookies and similar technologies for technical, analytical, and, where applicable, marketing purposes; the Cookie Policy and Privacy Policy, published on the Website, contain detailed information on data processing, involved providers, legal bases, and the rights of data subjects. Both policies are incorporated herein by reference.

QuotationIA will apply reasonable technical and organizational security measures to protect the confidentiality, integrity, and availability of data, although it cannot guarantee absolute invulnerability against cyberattacks, third-party failures, or circumstances beyond its control.

3. General Conditions and User Conduct Restrictions

The User agrees to use the Website in accordance with the law, good faith, and these Terms. Specifically, the User agrees not to: (a) insert unlawful, offensive, discriminatory content, or content that infringes the rights of third parties into the platform; (b) use false identities, impersonate third parties, or provide inaccurate information; (c) interfere with the operation of the Website, alter, manipulate, or reproduce without authorization the contents or code of the platform; (d) use the Service for unauthorized commercial activities under these Terms or applicable law; (e) attempt to gain unauthorized access to restricted areas or systems of QuotationIA; (f) distribute viruses, malware, or any harmful elements.

In the event of detecting unauthorized use or irregularities, QuotationIA may limit, suspend, or permanently cancel the User's access, without prejudice to taking legal actions it deems appropriate.

4. No Professional Advice

The materials, estimates, and documents generated by QuotationIA do not constitute, under any circumstances, legal, tax, accounting, technical, or professional advice. Estimates are generated based on the information provided by the User and on rules and data used by AI models; therefore, such results should be considered as indicative. If the User requires professional advice, they must seek assistance from a qualified expert in the relevant field.

5. Disclosure on the Technology Used (AI)

QuotationIA clearly and transparently informs that the generation of estimates is carried out using artificial intelligence models managed by external providers (primarily Google). The User expressly authorizes the processing of their data by such providers and accepts that the results may be processed, stored, and, where applicable, retained by QuotationIA or its providers for the provision of the Service, product improvement, and analytical purposes, always with the applicable data protection safeguards.

The User acknowledges that the probabilistic nature of AI models may entail inaccuracies, omissions, or recommendations that require human review prior to contractual or commercial use.

6. Modifications to the Website and Prices

QuotationIA reserves the right to modify, at any time and without prior notice, the presentation, configuration, functionalities, and conditions of access to the Website, as well as the prices of its services. Modifications will be published on the Website and, where appropriate, communicated to the User. Continued use of the Service after the publication of modifications shall constitute acceptance of the new terms and/or fees.

7. Account Registration

To access certain functionalities, including the right to download estimates, the User must create an Account on the Website. The registration and authentication process is carried out through QuotationIA's own authentication system, which manages user accounts, credentials, and login sessions, including sign-in with Google where the User chooses to use it.

The User must provide the data required by QuotationIA, which must be truthful and up-to-date. The User is solely responsible for all activity carried out under their Account and must maintain the confidentiality of their credentials. The User must immediately notify QuotationIA of any unauthorized use of their Account or any other security breach.

QuotationIA may set limits on the number of accounts per User, require identity verification, or deny, cancel, or suspend accounts if irregularities or violations of these Terms are detected.

8. Communications with the User

By registering, the User consents to receive communications related to their Account, payments, billing, subscription renewals, as well as notifications necessary for the provision of the Service, through electronic means (email, in-platform notifications, SMS where applicable).

The User will have the option to unsubscribe from commercial communications through the mechanisms enabled in each communication, without prejudice to communications strictly necessary for the performance of the contract.

9. Order Placement and Acceptance; Disclosure on Billing, Trials, and Subscriptions

The electronic confirmation of registration on the Website by the User does not imply automatic acceptance by QuotationIA; the Company reserves the right to accept or reject access requests for justified reasons. In the event of rejection, QuotationIA will not charge the User or, where applicable, will refund any amounts already paid, unless the rejection is due to the User's breach.

Access to certain QuotationIA Services, in particular the download of generated estimates, is provided under a recurring subscription model. In this regard, the initial registration grants the User a Trial Period of 48 hours (2 days) upon the initial payment of €0.60 (VAT included). During this period, the User may access and use the Service and download generated estimates.

At the end of the Trial Period, and unless the User has requested cancellation within those 48 hours, it shall be understood that the User authorizes the automatic conversion of their access into a monthly Subscription of €24.99 (VAT included). This amount will be automatically charged to the payment method provided by the User during registration (via Stripe as a secure payment processor), and the subscription will automatically renew on a monthly basis until the User requests termination.

To avoid the charge of the monthly subscription, the User must cancel the subscription from their Account area or by expressly contacting info@quotationia.com before the end of the 48-hour Trial Period.

10. Refund Policy

Unless expressly stated otherwise in a specific and explicit offer for a given product or promotion, payments made by the User to QuotationIA are non-refundable. However, QuotationIA may evaluate and issue refunds or adjustments, at its sole discretion, in the following circumstances:

  • (a) Duplicate charges or obvious billing errors attributable to QuotationIA or its payment processors.
  • (b) Charges made after a duly accredited User cancellation that were not properly processed.
  • (c) Exceptional cases duly evidenced where the User was unable to access the Service due directly to QuotationIA.

The User understands and accepts that, given the 48-hour Trial Period carries a nominal cost of €0.60, they have the opportunity to evaluate the Service before the first full subscription charge occurs. Once the trial period has ended and the monthly Subscription of €24.99 (VAT included) has been activated, payments made will not be refundable for non-use, early cancellation, or any other cause beyond QuotationIA, except in the circumstances mentioned above.

11. Payment

Service reference prices are expressed in euros, unless otherwise indicated on the Website. However, payments are processed through Stripe, which acts as an authorized payment gateway and may automatically apply currency conversion based on the User's location, the selected currency, or the payment method used.

The User expressly authorizes QuotationIA to charge, via Stripe, the amounts corresponding to the subscription and any other contracted service to the payment method provided (credit/debit card).

QuotationIA will not be responsible for bank fees, currency conversion surcharges, exchange rates applied, or any other additional costs that may arise from currency conversion or the policies of Stripe or the User's issuing bank. Such costs shall be borne exclusively by the User.

Stripe, in its role as payment gateway, is the data processor with respect to payment data and complies with the highest international security standards (PCI-DSS Level 1 certification). QuotationIA does not have access to or store the User's full card numbers. Furthermore, Stripe may use automatic card data updating services (card updater) provided by issuing banks in order to keep billing data current and avoid service interruption.

In the event of non-payment, chargeback, reversal, or any billing incident, QuotationIA may suspend access to the Service until the situation is resolved. QuotationIA reserves the right to invoice the User by alternative means, apply administrative surcharges, and/or initiate legal action to recover outstanding amounts, including costs associated with such actions.

12. Social Media

QuotationIA's presence on social media is subject to the rules and policies of each platform. Users participating in QuotationIA's public or official social media spaces must comply with these Terms and the terms of use of the respective platform. QuotationIA may moderate, edit, or delete comments that are unlawful, offensive, unsolicited advertising, or infringe the rights of third parties.

13. Copyright Notice in the Digital Era

QuotationIA respects the intellectual property rights of third parties. If you believe that any content available on the Website infringes your copyright, you may notify QuotationIA by providing: (i) identification of the rights holder; (ii) precise information regarding the allegedly infringing work and its location; (iii) a sworn statement that the information provided is accurate; and (iv) contact details. QuotationIA will address notifications in accordance with applicable law, taking reasonable measures and proceeding with temporary or permanent removal of the content if appropriate.

14. Disclaimer of Warranties

To the fullest extent permitted by law, QuotationIA provides the Website and Service "as is" and "as available," without warranties of any kind, express or implied, including, among others, warranties of merchantability, fitness for a particular purpose, or non-infringement.

QuotationIA does not warrant that the Website will be uninterrupted or error-free, or that the results obtained will be complete, accurate, or reliable in all cases.

15. Dispute Resolution through Private Arbitration and Waiver of Class Actions

The parties agree to first attempt to amicably resolve any dispute through written communication and good faith negotiations. If the dispute is not resolved within sixty (60) days of written notice, the parties agree to submit the dispute to binding, confidential private arbitration, in accordance with the arbitration rules mutually agreed upon or, failing such agreement, the applicable rules of a recognized arbitration center.

However, if the mandatory law of the User's country prevents waiver of access to ordinary jurisdiction or limits the effects of arbitration, the applicable legal rules shall apply. For claims exceeding five hundred euros (€500), QuotationIA may, at its discretion, submit the dispute to arbitration or to the competent courts of Barcelona (Spain), unless the parties expressly agree to another jurisdiction. For small claims, the User may bring proceedings before the competent court of their domicile where permitted by law.

Where permitted by law, the User and QuotationIA expressly waive the right to bring class actions or representative claims related to these Terms; any claim shall be handled individually. If the User wishes to opt out of mandatory arbitration, they may do so by sending written notice to QuotationIA within thirty (30) days of the initial contract, explicitly indicating their intention not to be subject to arbitration, following the procedure communicated on the Website.

16. Indemnification

The User agrees to indemnify, defend, and hold harmless QuotationIA, its directors, employees, agents, and providers from and against any claims, liability, losses, damages, costs, and expenses (including reasonable attorney's fees) arising from: (a) their use or misuse of the Website; (b) breach of these Terms; (c) violation of third-party rights; or (d) the submission of content that infringes the law or violates intellectual or personal property rights.

17. Third-Party Websites and Links

The Website may contain links or references to third-party websites and services. Such links are provided solely for reference purposes; QuotationIA does not control or endorse the content of external sites and assumes no responsibility for damages arising from their use, availability, or reliability. Access to third-party websites is at the sole responsibility of the User.

18. Testimonials, Reviews, and Other Submissions by Users

Content submitted by Users to the Website in the form of reviews, testimonials, or ratings may be moderated and used by QuotationIA for promotional purposes, always in compliance with applicable law. By providing testimonials, the User grants QuotationIA a worldwide, royalty-free, sublicensable, and transferable license to reproduce, adapt, publish, and display such content in any medium.

19. Electronic Communications

Unless otherwise specified, communications between QuotationIA and the User shall be deemed legally effective when made by electronic means. The User agrees to receive notifications regarding their Account and the Service at the email address provided during registration or through in-website notifications.

20. Assignment

The User may not assign, transfer, or convey their rights and obligations under these Terms without QuotationIA's prior written consent. QuotationIA may assign its rights and obligations, in whole or in part, in the event of a corporate restructuring, merger, acquisition, or asset sale, always ensuring continuity of the service.

21. No Waiver

The fact that QuotationIA does not exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right, unless expressly stated in writing.

22. Severability

If any clause of these Terms is declared null, invalid, or unenforceable by a competent court, such nullity or unenforceability shall not affect the validity of the remaining clauses, which shall remain in force.

23. Termination

QuotationIA reserves the right to suspend or permanently cancel access to the Website or a User's Account in the event of a breach of these Terms or actions that may harm the Company, its client network, or third parties.

In the event of termination due to User fault, QuotationIA may revoke access to the Account. Likewise, QuotationIA may retain the necessary information to address responsibilities or claims arising from the use of the Service, in accordance with the provisions of the Privacy Policy.

24. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy published on the Website, constitute the entire agreement between the parties in relation to their subject matter and supersede any prior agreement, understanding, or negotiation, whether oral or written.
